These Membership Terms & Conditions (“Membership”) between HomeTool.com Inc (“HomeTool”, “We” or “Us”) and the purchaser (“You” or “Member”) is for (i) HomeTool to provide You with assistance scheduling appointments with third-party service contractors (“Contractors”) to perform residential services at the address entered upon sign up and for (ii) You to receive discounted, no-hassle pricing from Contractors that HomeTool has pre-negotiated for our Members’ benefit. This discounted pricing is “at cost” with no markup to HomeTool. This is not an insurance policy or residential service contract. There is no obligation for You to use any of the services provided by HomeTool or Contractors. Membership is not available in California.
Introduction and Overview of Membership
Membership begins on Your order date and renews each month at the then current renewal price. Either party may cancel this Membership at any time, and HomeTool may amend or revise this Membership at any time. If canceled, Membership will continue through the end of the billing period with no refund for the pro-rata monthly portion. Payments are collected using a credit/debit card or included as part of a third party bill, such as a utility bill. Happiness guarantee: if at any time you are not happy, you can cancel your membership and receive a refund of your last 12 months of payments.
Membership Terms and Duration
Members place an appointment request by texting Us at 713-564-9028 or emailing us at Info@HomeTool.com. Normally, HomeTool will respond within 30 minutes during business hours. Upon receiving Your request, HomeTool will offer to schedule a Contractor to respond to your request. For each appointment request, You may choose to use or not use the Contractor. If you would like a different Contractor, or a different type of service performed, You may place a new appointment request at any time.
Appointment Requests and Contractor Selection
ARBITRATION: Any dispute arising out of these Terms & Conditions and/or the Membership relationship of the parties created hereby will be decided in Houston, Texas by final, binding and mandatory arbitration to be administered by the American Arbitration Association and conducted pursuant to the Federal Arbitration Act and the Commercial Arbitration Rules of the American Arbitration Association. The non-prevailing party in arbitration shall pay the other party’s arbitration costs. Any award rendered in arbitration may be confirmed by a court of competent jurisdiction, which the parties agree will be the state or federal courts located in Harris County, Texas. This contract, and all substantive aspects of the dispute, shall be governed by the laws of the state of Texas, but, except as to the process for confirmation or vacating of awards, no state arbitration laws shall apply. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING AGREEMENT TO ARBITRATE, YOU UNDERSTAND THAT YOU ARE WAIVING ALL RIGHTS TO A TRIAL BY JURY AND TO BRING A DISPUTE AS A PLAINTIFF OR CLASS MEMBER IN ANY LITIGATION OR AS A CLASS MEMBER IN ANY SUCH ARBITRATION.
Arbitration Clause and Dispute Resolution
You are responsible for paying the Contractor. Any service performed or equipment sold to You by that Contractor are solely between You and the Contractor. You agree that HomeTool is not responsible or liable for any service performed by the Contractor or equipment purchased from the Contractor.
